According to a latest update, the domestic handset-maker Micromax has been ordered to pay a big amount of money to Ericsson as penalty. If sources are to be believed, Ericsson has sued Micromax for patent infringements related to big-ticket technology. The disputed handsets and tablets of Micromax include some models from its popular Ninja series, Funbook Talk, and the Canvas 2 series.
It is worth noticing here that Micromax has refused to sign necessary licences for products compliant with the GSM, EDGE, and UMTS/WCDMA standards. As a result, Ericsson is claiming over Rs.100 crore as damages after three years of negotiations failed to yield a licence agreement on “standards-essential” patents.
The Delhi High Court has ordered Micromax to pay between 1.25% and 2% of the sale price of disputed devices to the court.
A spokesperson of Micromax said, "Micromax is committed to negotiate a FRAND licence with Ericsson. Since the matter is pending before the honourable court, it would be incorrect for Micromax to make any further statements on the matter."
Besides Micromax, Ericsson is also planning to take legal actions against a few other domestic cellphone makers, including Lava, Spice, Karbonn and Intex Technologies.
