
ANI accuses OpenAI of unlawfully using its copyrighted content to train ChatGPT, alleging that the AI reproduces its material without consent and generates false or misleading statements, potentially damaging its credibility and contributing to misinformation
OpenAI has strongly refuted copyright infringement claims by Asian News International (ANI), asserting that its AI model ChatGPT neither stores nor trains on data within India. The company made this statement during a Delhi High Court hearing on April 2, defending itself against ANI’s lawsuit.
ANI alleges that OpenAI has unauthorizedly used its copyrighted content to train ChatGPT, leading to the reproduction of its news material without consent. The news agency also claims that ChatGPT generates false or misleading responses, including fabricated statements attributed to ANI, potentially damaging its credibility and spreading misinformation.
OpenAI’s legal stand
Representing OpenAI, senior advocate Amit Sibal argued that India’s Copyright Act, 1957, does not extend to activities occurring outside India. He also clarified that OpenAI’s AI model does not explicitly reproduce copyrighted material in a way that would violate legal protections.
Additionally, OpenAI informed the court that ANI’s website had already been blocked from ChatGPT’s training data since October 2023. The company further emphasized that it has no servers, offices, or operational presence in India, reinforcing its position that Indian copyright laws cannot be enforced against it.
ANI pushes for compensation and content restrictions
ANI is demanding ₹2 crore in damages and has requested a court order to prevent OpenAI from using, storing, or reproducing its content. The case could have wider implications for AI-driven content generation and copyright enforcement in India.
As legal scrutiny over AI and intellectual property rights increases globally, the outcome of this lawsuit may set a significant precedent for AI regulation and content ownership in India’s digital landscape.
