BofA-USAA Deal Unlocks Banking Innovation
Bank of America and USAA have entered into a patent cross-license agreement, allowing both financial institutions to use technologies across their respective intellectual-property portfolios. The agreement covers strategically important areas including AI, machine learning, cybersecurity, network infrastructure, payment processing and mobile check deposits.
The agreement is notable given USAA’s history of aggressively defending its remote-deposit-capture patents. Previous disputes included litigation involving Wells Fargo and PNC Bank, while other institutions have reached settlements or licensing arrangements with USAA.
For Bank of America, intellectual property has become an increasingly important competitive asset. The bank previously disclosed a portfolio of nearly 7,000 granted patents and pending applications, supported by thousands of employee inventors and substantial annual technology investment.
The cross-license model represents an alternative to lengthy patent litigation. Instead of restricting access to innovations, financial institutions can share complementary intellectual property while preserving ownership, potentially accelerating development and reducing legal uncertainty.
The larger implication extends to AI. As banks increasingly develop proprietary AI, cybersecurity and payment technologies, patent portfolios could become strategic bargaining assets. Cross-licensing could therefore emerge as an important mechanism for accelerating financial innovation while reducing costly intellectual-property disputes.
