Residents of Mississippi have filed a federal class action lawsuit against Elon Musk's xAI and SpaceX, alleging that a massive power plant fuelling nearby data centres is generating "omnipresent and inescapable" noise that is destroying their health, peace, and property values. Three plaintiffs filed the case on behalf of an estimated 10,000 affected residents.
The lawsuit alleges that xAI and SpaceX negligently failed to control excessive noise and vibrations emanating from gas-fired turbines at the Southaven facility, creating a public nuisance that operates relentlessly around the clock. xAI subsidiary MZX Tech was also named as a defendant, though Elon Musk personally was not.
Plaintiffs are seeking damages for emotional distress, reduced property values, and a share of the companies' profits. Attorney Robert Wiygul captured the community's frustration powerfully: "Our homes are supposed to be a sanctuary. When invaded by noise 24 hours a day, it takes that fundamental peace away from us."
The Southaven plant, backed by Mississippi Governor Tate Reeves, received over $20 billion in xAI investment. The facility powers an expanding network of AI data centres — part of xAI's aggressive infrastructure buildout to support its growing computational demands.
This lawsuit follows a separate April filing by the NAACP, which accused xAI of violating US environmental regulations at the same facility — broadening the legal and reputational pressure on Musk's AI enterprise.
The US Justice Department has since signalled potential intervention, acknowledging that the dispute raises significant legal and policy questions about government oversight of America's rapidly expanding AI infrastructure.
